The legal battle between cyberlekka 'Taldeok Camp' Park and BTS has begun in earnest.
The Civil Division 12 of the Seoul Western District Court (Judge Lee Kwan-hyung) held the first defense day of the lawsuit for damages filed by V and Jungkook on the 23rd. The lawsuit is valued at 90 million won.
“The defendant has gained substantial profits from the plaintiffs, and we are suing them for falsehoods and infringement of personality rights covered in (the defendant's) video,” said Big Hit's legal representative.
Park's defense acknowledged that the video was posted. However, she argued that “considering the manner and content, it is only an opinion piece and does not constitute false and untimely defamation.”
Again, they appealed to the “public interest. “Some of the content is untrue, and since it was produced for public interest, it cannot be held liable,” he argued.
Park did not specify which content was true. She also said that the interference with Big Hit's business “did not reach the level of infringement.”
V and Jungkook are also facing criminal charges. BIGHIT has requested that the civil and criminal cases be kept separate, saying that it “cannot predict when or how the case will be resolved.”
Taldeok Camp is a celebrity slander YouTube channel. In addition to V and Jungkook, Park is also suing Jang Won-young, Kang Daniel, and others. They are accused of defamation.
In the case of Kang Daniel, he was fined 3 million won ($3,000) on March 12. In her closing statement at the time, she appealed for leniency, saying that she acted in the public interest.
The Jang Won-young case is in its second trial. In the first trial, the court ordered Park to pay Jang 100 million won. However, Park has appealed.
A criminal trial is also scheduled. The Incheon District Prosecutor's Office has indicted Park on charges of defamation and insult under the Information and Communications Network Act. The first hearing is scheduled for the second of next month.
Park is accused of posting 23 videos slandering celebrities between October 2021 and June last year. She is also accused of posting 19 videos degrading the appearance of five people.
